Defending Your Rights
We have represented clients in both contentious and non-contentious Intellectual Property related matters concerning trademark and copyright law. Mr. Santhalia is also one among many contributors in this field, with articles published on leading IP blogs such as SpicyIP.
We have successfully represented both employers seeking to protect their business and employees defending their right to work. In the landmark case of Stellar Information Technology Private Limited v Rakesh Kumar & Ors., CS (Comm) No. 482/2016 dated 29 August 2016, Delhi High Court, we successfully argued that an employer cannot use a confidentiality clause to unlawfully restrain trade, a decision that was widely reported. At the same time, we effectively represent employers in enforcing valid contracts to protect their interests, handling arbitrations against former employees for clear violations of non-compete clauses, as seen in RV Solutions Private Limited v Ajay Dixit & Ors., Case Ref No. DAC/2375/01/-19 dated 28 June 2020, Delhi Arbitration Centre.
